I spoke with the local En-Con guy on this matter just now by phone. He stated that without reading it, he was unaware it had passed but did state that he believes that this bill is not meant to include ml's and shotguns. Without me asking him, he brought up the 12 guage would be exluded if in fact this was meant the way it was written. He absolutely gave me no inclination that we needed to concern ourselves with the .54 cal ml's and 12 guages. He said that the gun that lawmakers had targeted were like the Browning .50cal. Hopefully this will put your minds at ease until you can clear it up for yourselves. I am not concerned about them coming for mine! grin.gif

This local guy is a friend of mine and is very knowledgeable in encon laws.

I have an Idea for you guys. Take your guns on a vacation. Then write a letter asking for demonstrasion on a firing range. Of course alot of NYC people would finger you for driving a General Lee lookalike.

Ok folks, here is the reply I got back from DEC.

I accessed the website that you are referring to and understand where you might be concerned. However, I am not aware of any law on the books restricting the use of 12 gauge shotguns for hunting big game. I also checked with DEC's Legislative Counsel and they provided the following information:

"Bill A.4471 (Assemblywoman Eddington) /S.2590 (Senator Schneiderman) has been around for several years. It has passed the Assembly a few times, as it did this year, but it has not passed the Senate. It did not move out of Senate Codes Committee this year."

This proposed legislation, a copy of which I have attached, is what I believe you are referring to. It is not clear to me that this legislation, even if it were enacted, would preclude hunting with either 12 gauge or larger shotguns, or muzzle loaders. However I do understand your concern.

In terms of legal hunting implements for Big Game Season, I refer you to Page 13, of the 2005-2006 "Hunting and Trapping Regulations Guide," which indicates that any center-fire rifle, shotgun 20 gauge or larger, or muzzle loader with a minimum bore of .44 inches may be utilized. This guidance is in accordance with Sec. 11-0901.4 of the NYS Environmental conservation Law. Therefore, hunting big game in New York State with a 12 gauge shotgun is an acceptable practice, as it has been in the past, and which I anticipate will be the case in the future.
