Identify your target, if you can't handle that, then you deserve, and will likely get a manslaughter charge. With the incident in Northern NY, the man was charged with manslaughter, not murder and was a relative of the victim. I have not read anything about the victim wearing blaze orange yet but I have not read the final report yet. Should find out more today. Muff Posted October 29, 2004 Author Report Share Posted October 29, 2004 Re: man shot and killed by uncle hunting? my buddy that I work with and he bow hunts with me was shot last year.30.30 at 50 yards...a hole thought he was a bear.he had a orange hat and full jacket on....bullet went in front of his right leg and came out just under his butt cheek....long storey short he is now back to work and came over bow hunting last week. So far what has been stated is that they were hunting and the nephew was walking out of the woods towards his uncle and the uncle "claims" he saw a doe and a buck running by and he fired at the buck and heard his nephew holler. He did not realize he had shot him until he walked over to him and the nephew was lying face down on the ground. The nephew told him, "You shot me" and that was all I guess. The uncle went for help. I'm not sure when he died as it did not say if it was at the scene or in the hospital. The guy that was shot was in full camo. In Northern NY blaze orange is NOT required by law at this time so he was legal. IF that is what happened, and I repeat, IF- then it is just a freak accident, and he should not be charged. SInce they investigated, and are charging him, I would tend to think that is simply a story made up aafter the fact, to cover up a bad decision. I know of a case in N.Y. where something like this actually happend as this man claims. Guy was turkey hunting with his nephew. He set him up and told him to STAY PUT until noon and he would come back for him. Well, at about 11, he(nephew) walked over towards the Uncle- unfortuately, so was a Gobbler. THe uncle shot, and as fate would have it, the goobler was not the only one in the line of fire. THe kid was in camo and behind leaves and the turkey- the spray hit him after it hit the turkey. Long story short, it was declared what it was- freak accident. THe Uncle was not charged, although he will have to live with that the rest of his life! [/ QUOTE ] Read my post... he was in FULL camo. It is still not an excuse in my opinion though. In northern NY, hunters are not required to wear hunter orange. Yes he should still be charged. He recklessly caused another mans death. Remember, know your target and beyond! Don't shoot at running deer if your not sure if someone could be there. I have no sympathy for the uncle. Someone lost a father, brother, son...for what?? A box of meat weighing approximately 25 lbs. Thats what it boils down to boys... would you ever want to be responsible for another mans life for a 25 lb box of meat? Its hunting, a sport, not life or death.
