007hunter Posted November 1, 2004 Report Share Posted November 1, 2004 First some backround. Yesterday me and my dad went out to move some treestands and scout around some. We hunt on private property. As we were scouting we found some elses treestand. Now me, my dad, and one other guy is allowed to hunt this property. We were pretty sure that this wasn't the other guys treestand as he normally stays on the other side of the farm. So we went and got the land owner. Now for the question. Does a land owner have the right to be able to take the treestand down and keep it? It is clearly on his property. I feel that what the land owner should do is take the treestand down leave a note saying if you want your stand come to the hosue and get it. This is just if he did not damge the tree. If he put the screw in steps in the tree I feel that the land owner has every right to just take the stand and keep it w/o a note. The guy pretty much just ruined the tree. I'm not sure in other states, here in michigan they just had a big talk on that. If a land owner found a treestand on his property, can he legally take it? NO! You can not take it with intent to keep or to give to someone else. BUT you can take it with the intent to give back to the person whom was trespassing. This usually happens: owner leaves note, tresspasser usually knows he or she is tresspassing! The tresspasser never comes and gets stand, if he or she does, he or she has a chance of getting prosicuted. First off, trespassing in PA in a criminal offense and the Game Comm. won't do anything about that...have to contact local/state police. However, since this person used screw in steps, they broke a game law by not having written permission from the landowner to do so! As far as the stand...if I find one on my property...its mine, end of story. My wife and I pay the taxes and the stand doesn't belong there. I personally have no probs. taking the stand. I would leave a note on the stand the the trespasser has 2 days to remove the stand otherwise it becomes the landowners property. I say if your bold enough to trespass on someone land and leave something behind such as a stand..I say it belongs to the land owner period....I hear this all the time , but he gave me permission to be there..and I say to that if it's not in writting it never happened. We just had this happen the other day on my farm, my brother house is a county sherrif out here had the day off the day following us finding the stand. My brother went out and found this guy sitting on the stand and arrested him for tresspassing on the stop, and the DNR officer wrote him up for not having a bow tag. We found some years back while we were squirrel hunting. We cycled a few 12ga shells through the seat and that ended that problem. The next time we went back the stands were gone....imagine that!
