PRESS RELEASE

New York State Police

The New York State Police in Adams are investigating a hunting incident which occurred at approximately 11:50 a.m. on Oct. 16.

Larry D. Smith, 47, 16472 County Route 68, Watertown, was hunting with three other individuals in a wooded area approximately one mile north of the Freeman Creek Road in the town of Watertown.

Smith became separated from the group and entered an area of heavy brush. Another member of the group, Edward D. Smith, 71, 16472 County Route 68, Watertown, saw movement in the heavy brush and discharged his muzzle loader into the brush.

The round struck Larry Smith in the lower abdomen. He was treated at the scene by Town of Watertown Fire Department and transported to Samaritan Medical Center for treatment.

Larry Smith is currently in stable condition.

The investigation is continuing.

The following agencies assisted at the scene: Jefferson County District Attorney Cindy F. Intschert, New York State Department of Environmental Conservation, Jefferson County Sheriff's Department, Town of Watertown Volunteer Fire Department.

I just don't understand the mentality of some hunters, identify your target, identify your target, identify your target.........how easy is that to understand? This guy should lose his hunting priviledges and be required to take hunter safety class over again and go around to schools and preach about safety with guns and while hunting.

Shooting into heavy brush and not knowing his target, what an idiot!! frown.gif

I think there should be a State law that says "if you shoot someone while hunting or while they are hunting, you receive a minimum sentence of 20 years in jail of which 20 years must be served". Then this crap will stop. A law that says you must clearly and positively identify your target should do it.

You cannot call something an accident that violates the basic laws of firearms handling. Don't touch the trigger unless you are ready to shoot. You cannot be ready to shoot unless you can clearly identify the target.

There was one that had a hole through the HUNTER ORANGE VEST and they had the nerve to call it an accident! Unbelievable.

Throw him under the jail, IMHO. This was no accident....it was carelessness plain and simple.

it amazes me that people see a bush move and they fire. if i remember my learnin right if the bush moves and it is loud enough for you to take notice then you wait untill you see the deer then shoot not the bush moves kill it. sad state of affairs. they should revoke his hunting privledges for his stupisity and if i was the guy he shot i woould find a way to kick his ****

This is the exact reason why I don't gun hunt deer and I only archery hunt. I also stay out of the woods during the gun season. Every year people get shot because some stupid hunter didn't verify the target before pulling the trigger.

Like others said the guy should lose his license to hunt for 5 - 10 yrs. Accident or not there is no excuse for shooting into a brush pile because you saw something move. Wasn't the guy wearing hunter orange?

Why would you EVER give a license back to someone who killed or wounded another person? They forfeited their right to hunt when they shot another human being because of their negligence.

That goes for anyone caught for a serious game violations like baiting or night hunting or blatent trespassing. Yank their license forever. That is the only thing that matters to these folk, so take it.

I was with a guy who stopped short of night hunting because he was afraid he would get caught by the police and show up in GON's hall of shame. Didnt' fear punishment or being arrested, it was public humiliation that scared him.

That is scary, since this is going to be my first time to hunt and my sons ,even thought we are gonna be on my father in laws land I am still making me and my son wear hunter orange vest and hat

some accidents are just that but most can be avoided. i would not want the guy who shot me to have had to spend time in prison for a stupid accident or laps in judgment. They say you cant fix stupid. he never made that mistake again and i would say hes become a advocate for safe gun handling. criminal who deliberately harm one another need to be punished. A little history we were both in our mid twenty's and nether had taken a hunters safety course however both ex military. since then we both took a hunter safety course don't be to quick to ruin a young mans future Please.

told my buddy about this and you could just see him turn abit white....I think it brought back 2 years ago when he was shot in the leg....same thing happened to him I think the guy took a sound shot....my buddy is very lucky to be alive!

Just plain stupid!!! Just like you all said first thing in gun saftey is identify your target. Quick little story...Last year I am hunting on my Brother-in-Laws land. At the time he was in the middle of building his house. I heard the nail gun going off so I knew he was there. Now I am like 500-600 yds away. I heat some crunching coming from the direction of the house so I safety my shotgun figuring its him coming over to me. Well low and behold a 5 pointer pops out about 20yds away.

I only write this to show that know your enviornment, know what is going on. If your not sure dont guess and think its the deer of a lifetime cause you could be taking another persons life!!!

BTW I just finished my last roast of that 5 pointer :-)

I would offer the choice of him going to jail or me beating the bajeesus out of him. Jail would definately be easier. It was not an accident, the shooter deliberately aimed and fired. The target may not have been what they thought it was but it was not an accident.

The only way I see it as an accident, is if an previously safe gun malfunctions, or a part breaks that is not induced by the shooter. Anything else is pretty much negligence.

WHAT! mad.gif Are you kidding!! What about future of the wife who could of been widowed. What about the future of his kids who would have grown up without a father, not to mention the grandchildren. When he CHOSE to abandon all the rules of safe hunting he chose to accept his consequences. What if you were speeding and had an accident and put someone in the hospital? Would you like special treatment? It's the same thing basically. Like AJ said, "Individuals have to be responsible for their actions." Please think before you make such statements.
