So if I shoot at a deer and blow off a front leg and track it for miles...its my deer even if someone else kills it?

BS...if I make a bad shot on a deer (fatal or not) I hope that if I don't find it...at least someone else put it out of its misery and got to eat the meat!

The only thing ethical about this situation is that the first shooter didn't make an ethical kill shot. Sorry, truth hurts sometimes...but like AJ said..."hopefully you will make a better shot next time."

This is a tough post, but I have to say I agree w/ the landowner who kept the buck. Here in WV, we follow the 'Last killing shot takes it' rule.

If you're hunting and hear a gunshot nearby, lots of time deer will run by, & if one is a bruiser buck, then you're gonna shoot to kill it. Even if it's wounded, you killed it, so you're gonna keep it.

I'm sorry you lost such a nice buck, but there will be more. Good luck the rest of your season.

It's a bad situation for all involved IMO.

I've never had it happen to me but I hunt a lot of public land and have often wondered what I would do if I made a GOOD shot on a deer and it crossed a ridge and a unseen hunter 75 yds away put it down before it had time to expire.

If I were hunting and heard a shot and then saw a deer coming my way I would try my best to see if the shot was lethal or even if the deer was hit....if it appeared to be a lethal shot I would let the deer go and even assist in the tracking. If it was a poor shot I would shoot the deer and try to put it down....once the other hunter got there I would show him his shot and explain why I shot it. If they were still dead set on saying the deer was theirs I would most likely let them have it anyways.

I see alot of fatal shot posts and people saying that the gut shot is fatal...Yes it is fatal, but not fatal right away in most cases. That deer would have lived several hours maybe even a couple days before dying. It's a tough situation, but like it was stated before the hunter probably had no idea the buck was hit and even if he did he couldn't have a clue who hit it. Just b/c your nieghbor shoots doesn't mean he shot THAT deer....As for people saying they couldn't claim another deer that someone shot. Most gut shot deer that I have seen have went a long way and typically blood has been lost and they have been stumbled across later on, or the birds have found them and that's how they get found. Unless that shot was in the boiler room(which it wasn't) then the second guy has rights to the deer. Now I would be mad as all get out if you smoked him and he jumped a fence and got shot as he was going down. Then I would have issues.

A gut shot deer comes by you and you put it down and then the guy that gut shot it shows up on your property and says "Hey, i shot it first". You would say "Tuff luck, better luck next year". Thats what property boundries are these days. The best shot counts. Sorry for your day but get out there tomorrow and see if you can find another big boy. It is Illinois after all.

I know exactly how you feel. Last year while hunting with my dad (my very first hunting trip ever), my dad hit a nice 9 pointer. A few minutes later we heard 3 shots right in a row. We started tracking the deer, but my dad had to take a break (he has C.O.P.D.) I went up to the truck to get my aunt to help track the deer, while I was waiting for her to come to the truck, a man in a white truck drove up, and said he wanted to show me the deer that my dad shot! My dad and I had talked to this man when we had first gotten to our spot. Anyway, he knew my dad had shot the buck, and he went ahead and shot it 3 times and claimed the deer, which I totally thought was wrong, my dad was upset about it, but he said at least the deer would not be wasted. I took pictures of the buck while standing there. It's still aggravates me to this day. I have been out deer hunting from Opening day of bow, and plan on hunting throughout all the seasons, I hope I eventually will get one, I am going to dedicate it to my dad, since he can no longer hunt regardless of the sex of the deer.

Nothn you can do about that. Even if you made a good lung shot and the deer ran over to his property and he made a bad shot. THe deer is on his property so he has the right to keep it. Especially since he spined it and it dropped, it is definatually his deer.

Better luck next time, these things do happen though. My eight point I got 2 days ago was shot by the neighbor and it ran onto our property, I made the kill shot by shooting him in the neck while he ws running towards me. So, my deer. But I did ruin all the neck meet because my 300 weatherby left a softball size hole in the back of his neck!!!!

i would be upset too. knowing it was a matter of time the deer would have died, it was his lucky day to be in the stand, but than again he might have been the type of land owner that would'nt have let you go and get it or told you its on my property and its mine, it just makes you want to make sure your shots do the job the first time.
