Guest Turtle Posted March 30, 2008 Report Share Posted March 30, 2008 I read the story and still don't know who to believe. Is it part that gets taken off during inspection or not? If it was marked why was it in storage and not returned? After MWR's little fuel additive last year I wouldn't be too quick to call it either way. I can see why Jack has questions and would want to possibly investigate further, but without further investigation wouldn't label MWR as biggest cheater either. BowJoe Posted March 30, 2008 Author Report Share Posted March 30, 2008 I personally think he has major juevos to accuse anyone of stealing or cheating considering how he runs his camp: i.e. ;Carl Edwards and the infamous oil lid. Did Michael Waltrip steal his part?... obviously, he had the part therefore possession is guilt in my opinion. Whatever the purpose, the law is blind to intent when possession is fact. I'd say that if Rousch pushes with the law, then he'll win based on the intellectual property if Rousch had it documented prior to the theft. I would think patent law comes into effect as well as copyright law. If you don't have a patent, then you don't have a case. What I have a question about is can you patent or restrict others from using information gained for the sake of a sport in which every team tries to gain an advantage? Can you say that because you have a specific setup that another team can't use that same setup as well? Bottom line is that Rousch is a multi-millionaire and will never have to worry about money or his place in NASCAR's record books. Why tarnish your image and make this a public nuisance when you could handle it privately and not hamper either reputation. Was Michael Waltrip Racing guilty... yes but I don't think MW himself said, "Go steal that part." I think he definitely needs to hire better people in his department. Obviously, they think that doing something for the betterment of MWR is more than justifiable of the means. What else I don't understand is if the part won't fit on a Toyota then why even steal it? Another point is, if they really meant to use it then why was it sitting on the shelf instead of somewhere else like on another car? One last point to all of this is if this information is so important then why did Jack spend a half hour explaining how it worked, how it was altered and what the features were? That's crazy!!! AdvantageTimberLou Posted April 2, 2008 Report Share Posted April 2, 2008 In Jack's eyes everyone is cheating but his teams yet he has been caught this year cheating or as they say, "the bolts loosened up under race conditions"! LOL!! He needs to quit the whining and get to winning races. As for the sway bar, not sure how Mikey got it but they should have returned it sooner instead of this "Swaybargate" that is now going on. The part was a sway bar Bowjoe from what I have heard and it would work on any car. The chassis's are just tubes of steal and you can take any sway bar and make it work on any chassis with slight modifications. The thing they probably learned was the thickness of the bar they were using and they may have experimented with it to see how it worked on their chassis. The diameter of the bar will give you an idea of what type of spring combination they are using. Most cup teams use a big bar, soft spring set-up.
