The town of Swan Lake, is only like a 10 or 15 minute ride from the town where my family's property is, so this is basically a local incident. This article was on the front page of the paper up there according to my dad. http://www.recordonline.com/apps/pbcs.dll/article?AID=/20081117/NEWS/81117013 According to the news report on tv that I just watched, the man is being held in the county jail on charges of second degree manslaughter. NYS Law states that you must be 500ft away from an inhabited building or structure without written permission from the landowner, and I really doubt he had permission from the owner of the trailer park. He could not imagine how a toddler so little and innocent, standing behind the safety of walls and being looked after by her entire family, could be killed in such a way. I realized it was an accident, but he should be prosecuted! he has to know what is beyond his target and shooting a rifle he knows that bullet is going to carry a long distance. from the look of the pic. it looks like the stand is fairly level with the ground the trooper is standing on. camocop Posted November 19, 2008 Report Share Posted November 19, 2008 i am in no way condoning hunting close to dwellings BUT before everyone screams for a hanging think about it. if he was in a tree stand, he had to be aiming towards the ground to shoot at a deer. if the bullet was travelling towards the ground, it might have richocheted (sp?). no one can control a richochet bullet and it can happen to anyone no matter how safety conscience you are. prayers are sent to the family of the child. Think I read a story about a horse or pony killed by a shotgun shot from well over 200 yards away by a hunter somewhere in the past few years, typical story of mistaken identity and a trigger happy shooter. Modern day slugs can travel and carry plenty of energy to kill a lot farther than 100 yards. Bottom line, the guy squeezed/pulled the trigger not thinking about the consequences or dwellings and surroundings. He may feel bad about it, but that does not bring back the innocent little girl or negate his act of total ignorance. There is NO EXCUSE for this type of thing to happen ever. After wounding the deer, the 2nd, finishing shot, is the one what killed the child. The hunter was hunting over bait, illegal in NYS, he tagged a illegal buck, less than 3 points on one side. He was hunting over a salt lick, illegal in NYS and was less than the required footage from the residence. This guy was recipe for disaster. Look at how many laws he broke and to take the life of a innocent child too. He is being held without bail. There is a BIG cry now to ban the use of rifles in the county due to this incident. It has always been a rifle county and more counties this year in NYS changed to rifle also this year. Prayers for that little girl and her family. I just can't imagine if he was using a 300 mag. that a second shot would even be needed! He was careless of hunting that close to a residential area even if he had permission from the land owner.Wich raises a question. Second to AceArcher, you really need to get and read the Il. hunting regulations book. Gun season includes handguns, not just shotguns.
