ladydiehard Posted November 19, 2008 Report Share Posted November 19, 2008 Few years ago my uncle purchased an additional 5 acres to "square up" the family owned property. Turns out a guy hunted this 5 acres with permission and had been doing so for years. Lucky me just had to be the one to encounter this guy while we were making a drive that included this new 5 acres. He was arrogant and rude and informed me I was trespassing. He stated whose land he believed he was on and I explained it had been sold and who the new owners were. Instead of being polite and maybe asking if he could continue to hunt it this season, he got rude again and stated he knew nothing about any sale of the property. A fellow hunter overheard our conversation and told my husband how rude the guy was to me. My husband, being a hot head, confronted the guy at his vehicle later that day and told him to get his stand off our property. My uncle eventually heard of the incident and a couple weeks later went to see if the stand had been removed. It was still there. It was a junky makeshift stand nailed into the tree. My uncle, being a retired lumber man, hates nails in the trees anyway so he simply cut down the tree. This little 5 acres is nothing but cedar swamp but it yields several deer to our group every year. The guy could have continued to hunt there but he just couldn't be nice! I've had several encounters over the years with rude male hunters. Lord help them all when the guys in my group find out about it. I have great defenders. If he is man enough to call, come get his stand & let you know who he is, I would just go with that. would have a talk with him & let him know that if he does trespass again that you will get the law involved. I am not saying you are wrong, you are well within yout rights to do so, I just feel everyone deserves a 2nd chance , so to speak. Especially if he is man enough to call you. IF...and we all know how big of an IF that is...that the guy did not know he was trespassing and he convinces you of that when he calls...I'd say give him the stand back. He did something wrong and may learn a longterm lesson out of the deal so it does'nt happen again to you or someone else. Along with a piece of your heart felt concern about the safety issues being that it was hung so close to your home! You never know how things may turn out and if handled well on both sides of this you may end up with a new friend. (treat people the way you would want to be treated) On the other hand... If he's beligerant when he calls...Hang Up! If he calls back after that let him know that you appreciate his effort and the confirmation of his phone number for the police to have. I've never heard of a landowner getting in trouble by taking someone's stand that was on the owner's property and the hunter didn't have permission. If you left a note saying to contact you to get it back, then that sways thing in your favor even more. There are more and more hunters it seems and only so many places to hunt. As sportsmen we all have to practice good ethics. If the land was clearly posted then it's only ignorance that has allowed the person to go on your land. When you enter upon property that is not owned by you, or for which you do not have access by permission, that is trespass. Now that buddy knows that you have his stand, what will you do if he decides to bring charges against you for stealing it? Do you have the necessary proof that the stand was originally placed / found on your property?...Is it documented?...Do you have an impartial witness?...What's to stop buddy from saying that YOU stole the stand from a neighboring property, or something of the sort? The world is full of 'Right and Wrong'...and I never believe it is Right to keep that which is not yours. I think you did the Right thing by leaving the note and offering the stand back... But I think the most proper course of action would have been to contact the authorities...have them come to remove the stand or witness it being removed...and then have them take the stand...leave the note for buddy to pick it up at the local DNR or police station. That removes any aspect of the 'theft' scenario I mentioned in paragraph one...and you are protected in the eyes of the Law. Before you found this one, you didn't own this kind of stand...So there is nothing lost by giving it up to the authorities. If you want, let them know that if within a year the guy hasn't shown up for his stand, you want it back...that it will then be your property. Just my 2 cents... Is it possible this person may have had persmission to hunt the land before your families purchase? I would remove the stand and leave a baggie with a note nailed to the tree. The note would state that this is private property and you are trespassing. If you want your stand back then you can call for it.
