Define Poaching........????

This whole issue can be a very extensive and explosive item............ but I ask that we keep it civil and adult.

The every-day use of the term "poaching" would lead us to assume that one is out "shining" or illegally taking game by some other means, whether it be tresspassing or running them down with a vehicle. Now, I fully understand that game laws vary alot from state to state, or province to province, or region to region. You can "Shine" deer in certain parts, and not in others........... and you can use a vehicle in certain parts and not in others. That's fine. We understand that. No point in arguing the law of certain areas.

But, in your opinion......... when do you call something "Poaching"????????

Is it the illegal taking of game according to the law??

That's how we perceive it at times...........but.........

If you have ever walked back to your truck after legal shooting time with a gun/bow in your hand......... you broke the law. While you are walking back to your truck, you are still hunting, according to the law.

If you and your buddy are bird hunting......... and you have more than the legal limit in your vest for one individual....because your buddy didn't have vest and he gave his birds to you............. you broke the law. Possesion limits vary in certain areas I understand.

I guess I'm trying to ask..............

Right is Right.......... and Wrong is Wrong.........The letter of the law is sometimes vague.......... or at the very least........."up to the discretion of the arresting officer".

Where do you draw the line???????????

It's not a trick question, just thought we'd get a little mind expansion, or a little food for thought.

In response to walking back to your truck; In our state it is defined as legal shooting hours and not legal hunting hours. Therefore if you are walking back to your truck after legal shooting hours, you aren't breaking the law unless you shoot an animal.

i agree as well. For example here your gun must be in a case after legal hours, so walking back from my stand i throw it in a gun sock(counts as a case). While some poaching is more serious(ex spotlighting) anything against the hunting regulations does technically make you a poacher.

Its pretty black and white really.....your hunting hours are listed in the dnr regs. shooting outside of these posted times is illegal. I dont necessarilly agree with these, in say snow on the ground when you can see longer into the day. But, the law is the law, and if caught like you say "walking back to the truck" you are illegal if your weapon is not cased, and its after hours. Prob. the best thing next to no case, would be to have the weapon clear and broke open(gun) and with a bow, padlock the cam.

I think I would have to insert the word "knowingly" or "willfully".

I had a friend who lost his license for 3 years for poaching. He shot a deer at about 150yards from his deer stand. He didn't know, and couldn't see a dirt road from the stand, but in Arkansas it's illegal to shoot from or accross a road. I've been in the stand and you can't see it, and he came in through the woods and he didn't know the road was there. He showed me where it was we went in from the road where his truck was, and you couldn't see the road at all, even up in the tree.

He is a very honest guy who made an honest mistake. I don't think he is a poacer at all, but I guarettee this year (his first year back) he didn't even think about shooting in that direction again, and will probibly do a lot more pre-season scouting.

There is poached, poached, poached, and then there is poaching...its all in the definition really....as you have asked:

"Define Poaching".

poach

v. poached, poach·ing, poach·es

v. intr.

As for Land....

1. To become muddy or broken up from being trampled.

2. To sink into soft earth when walking.

As for Sports...

To play a ball out of turn or in another's territory, as in doubles tennis.

As for Eggs....

The secret to pretty poached eggs is using very fresh eggs which will hold their shape better and produce fewer “angel wings” in the liquid. Adding salt to the poaching liquid may promote coagulation and adding vinegar may lower the coagulation temperature, but neither are necessary and can flavor the eggs. Swirling the poaching liquid or creating a vortex merely serves to ruffle the delicate egg protein. Nicely-shaped eggs are easier to produce in relatively quiet water that is gently simmering.

Dont think so. The way the law reads here as I understand it, I would have to disagree with what you say there.

Yeah...its not always black and white in my book. We all know the big ones...but some of the stupid "PA" laws are hard to understand sometimes.

Example: Taking advantage of Food or Bait: It is unlawful to hunt in or around any area where artificial or natural bait, food, hay, grain, fruit, nuts, salt, chemicals or minerals, including their residues, are used or have been used within the past 30 days as an enticement to lure game or wildlife regardless of the type or quantity.

So where exactly am I alowed to hunt? That is all one sentence taken directly out of our game book.

There are others...but I'll just leave it at that.

I would define poaching the same as many have already; taking game or fish illegally. However, I would not call someone a poacher, unless they intentionally broke the law. Walking back to your truck with your gun loaded after legal hours, I wouldn't consider poaching unless you intended on shooting a deer that walked out. I know, if you are caught (with your gun loaded), you can be charged with a poaching offense. The point I'm trying to make is, take your friend for instance; I would not consider him a poacher for shooting across a road he didn't know was there. Had he known the road was there, and shot across it anyway, he would be a poacher. But, when it comes to enforcing the law, how does a game warden know what your intentions were?

Ok, so how in the heck are you supposed to get back to your truck. confused.gif Leave your weapon out at your tree stand. I never heard of that law. Maybe WALKING BACK WITH IT LOADED OR AN ARROW KNOCKED is illeagal but not what you said. Might want to check that one! confused.gifwink.gif

Not according to our laws here in TN. If you walk back to your truck after regular shooting hours and your gun is LOADED, then you have broken the law...

But that in itself IS NOT poaching...
