wtnhunt Posted June 1, 2009 Report Share Posted June 1, 2009 Guess that probably depends on whether the firearm is being tranferred. UPS will ship firearms where they pick up without an ffl. If it is a transfer, I am betting they will not do it without it coming from a current ffl. Last time I picked up a gun from an ffl the place I was picking it up from would not release the gun to me due to a question on the validity of the license from the shipper. Shippers ffl had expired, however they had an extension and there was a note with that information but he was not willing to accept that without authorization from his atf guy. He called the atf and I had to wait, held me up about 45 minutes. With looking at gunbroker, it appears some ffl holders are more particular than others, some will require a hard copy, some will take a faxed copy. [back] A nonlicensee may ship a firearm by a common or contract carrier to a resident of his or her own State or to a licensee in any State. A common or contract carrier must be used to ship a handgun. In addition, Federal law requires that the carrier be notified that the shipment contains a firearm and prohibits common or contract carriers from requiring or causing any label to be placed on any package indicating that it contains a firearm. [18 U.S.C. 922(a)(2)(A), 922(a) (3), 922(a)(5) and 922(e), 27 CFR 478.31 and 478.30] This is from the ATF website. Technically ANYBODY can ship a firearm to an FFL anywhere. Not all FFL's are willing to accept shipments from non-FFL's, though. If that is their policy, that's their prerogative, but it is not required by law. A faxed copy of an FFL is all that is required by law for an FFL to ship to another FFL. You may ship long guns via USPS, or a common carrier like UPS or FedEx. Handguns can not go through the USPS. A few years back I needed to ship my derringer. I asked if I needed an FFL dealer to ship it. He told me to take it apart and ship it as two separate packages. No matter how "taken apart" a gun is, the piece with the serial number is the piece that, even without all the rest, is a "firearm". If you ship that improperly, the G men may be paying you a visit. After the G men pay you a visit, you can hope your family will pay you a visit, on Tuesdays between 1:30 and 4:30 at the federal penitentiary of the government's choice.
