If she was not moving and was hit while she was stopped, it should be a no brainer. See if they can get you a loaner car while yours is being repaired or situation resolved. We were able to pick up a rental this past weekend so at least she isnt having to drive my truck around. We are still having problems with the insurance company. If they dont become a little more responsive im calling a Lawyer. Im not going to play the back and forth game with them. The lady working the accident literally wont even return a phone call. For some reason she already doesnt like me.... My wife and her mom are sore. They are on muscle relaxers (per the ER doctors perscription). If her Mom and your wife are sore, suffering legitimate hardships...then by all means get a lawyer. Insurance co's respond better to lawyers anyway. Many regular people don't know what to do when they get the run around from Ins companies. Lawyers do. I am not saying make a frivolous suit, but if there are legitimate hardships...then by all means pursue your legal options. Hope it all works out and things get back to normal. stevebeilgard Posted September 22, 2009 Report Share Posted September 22, 2009 before you contact a lawyer, maybe call your insurance company. tell them what happened and that the other guys insurance company is giving you the run around. give them the other insurance adjusters name, and tell your insurance you may have to make a claim on the uninsured motorist portion of your policy. they will straighten out the other insurance company REAL fast, as they all play the same games. any insurance company i've dealt with has one goal... deny the claim. you are covered for everything except that which went wrong. scam artists. but a car accident is pretty simple. the cop on site will issue a ticket to the person in the wrong. Good luck with that Jeramie, be sure that you get names of people and document everything, hope it work out so that your insurance goes after the responsible persons insurance. We had allstate as our insurance company for both home and auto. So much for the advertisements they run. Wife took a mailbox last spring in our then 2 month old durango instead of a head on collision, and the forgiveness we get is raised premiums exceeding the damage, plus they put the incident down as being "at fault" charged to us. Did later on get the "at fault" part corrected after fighting with them, but that was like pulling teeth. hutchies Posted September 22, 2009 Report Share Posted September 22, 2009 I've had it out with allstate as well. They tried to tell me that I didn't make a monthly payment and cancelled my insurance. I go thru a local company so I called him up and told him to get me swapped to someone else he carries. When they found that I made the payment they reinstated my policy which I told them to cancel.
