Doc Posted October 27, 2009 Report Share Posted October 27, 2009 Doc- I actually agree that there are some responsible ATV owners out there, but the vast magority of ATV owners have went out & bought themselves a real nice toy that they dont even have property to ride it on. They just figure that since theres an established trail there that they own it like a state highway. Vast majority?? That might be so, but that's a pretty tough allegation to prove with any certainty. You might be right, but then too, probably not. Remember that there are a lot of legitimate public and commercial trails, as well as a lot of property owners and renters who have enough land to use them responsibly and without any intent to tresspass. One thing about an ATV is that they aren't exactly quiet and stealthy. Plus an awful lot of landowners now have them strictly for patrolling and catching (and prosecuting)these noisey intruders. Here in NYS, there is another risk that tresspassing ATV owners run besides trespass prosecutions. They are also required to be licensed and insured. My guess is that tresspassers probably wouldn't bother complying with those laws either. So the fines could start mounting up fairly significantly. By the way the best way to combat trespassing isn't by worrying about ATVs, but rather by pushing state legislators to pass heavier fines for tresspassing. Something with some real teeth. That would go a long way toward eliminating trespass regardless of the mode of transport. It would also come down on the biggest category of trespassers......that being the ones who come in on foot. When I hunt by a road I sure don't walk 1/2 a mile to get there noemally about 100 yds.If you walk in a 1/2 a mile there shouldn't be any roads around Depends on how your access is set up. Sometimes you can't park near where you want to hunt. I run into that on some private land that I hunt in Indiana. I would have to walk 1/2 mile to hunt an area that is 200 yards from a road or worse yet 100 yards from where I used to live. Depends on where you can park. Private ground that he has no permission to be on at that. I cant tell you how many pieces of great hunting property I have lost access to because ATV operators p***ed off the landowners. sorry for the rant- kinda had a bad evening here!!! In my country there are old logging trails that are passable to an atv 1/2 mile, 1 mile , or whereever you want to hunt. I hunt some state land that has been opened up to a huge mountain biking club that was given permission to put in whatever trails they want. So they did. They have a network of trails covering the hill such that you are never out of ear-shot of at least one of them. Worse yet, hikers and large hiking groups have taken advantage of these trails, and the whole hill seldom sees any respite from the constant pressure of hikers and bikers. Now, try to bowhunt in such an area. That's pretty much impossible. Yeah, there's still plenty of deer there, but they have taken up some very rigid nocturnal habits. No, there is no trespassing going on, and these people have a complete right to be there. That doesn't make it any less frustrating. Gun season these hiking and biking people all go away, and the hunters do get the deer moving in legal shooting hours. But bow season has been completely ruined. Sounds like you got a couple delinquents that have no fear of authority. Good Luck. I don't think I would have any patience. Sounds like you bent over backwards trying to get them to stop. MichiganHunter Posted October 29, 2009 Report Share Posted October 29, 2009 (edited) Sad that people lump all atv users in the same group...I agree some people use atv's poorly but most of us them as effective hunting tool and land matinance tools...and there are laws that prohibit people from trespassing on private roads, and remember someone chould just as easly walk in to where you are hunting...and I dont know about your state but in Michigan there are hunter harassment laws, and if someone is doing it on purpose you can get them on that....I know your not trying to lump everone in but remember lots of the people on here own quads and dont ever miss use them....our quads have infact opened areas of our property that we were never able to hunt at night because if you shot something it takes about 3 hours to drag a deer out....Not all quad users are bad... BUT I wish you the best of luck and I hope you are able to resolve the issues you are haveing with this trespasser. Also, there is something about the occasional sound of an ATV on posted property that helps deter trespassers and other law-breakers. davetucker Posted October 30, 2009 Report Share Posted October 30, 2009 i hear ya also!!There is this one farm thats probably 750 acres owned between 3 different landowners and you might get permision from one for one part and not the other but some ignorant people take it that they can go on all of the farm!!This is one of the hottest funnels from canada around and alot of big deer been taken there!!
