The_Kat Posted December 2, 2009 Report Share Posted December 2, 2009 Well Jenn just got a ticket for careless driving....teehee! 245$ at Christmas time is just what the Dr. ordered. There is a turn in at Wal-Mart here that is clearly marked DO NOT ENTER, yet everyone always enters their lot from there if they are coming from the west. Well sure enough Jenn was on her way into town and a guy suddenly stops in front of her and signals at the last minute to turn in there, changes his mind in mid turn and darts back in front of her. Jenn has to slam on her breaks in turn screeching her tires. Her reaction causes the guy in the lane next to her to do likewise to try and let Jenn get over, but there was no need Jenn stopped in time and the crash was avoided. Two stoplights later Jenns pulled over and getting a lashing from the Captain of the Durant PD. I won't post what all he told her, but he chewed her butt pretty good saying she bout caused a wreck, etc, etc. He wrote her for careless driving and threatened her with other tickets..... She called me in tears, told me the story, and instantly I found fault with her getting a ticket here. The dude in front of her is the one who broke the law....and regardless of whose at fault, you don't talk down to people as an LEO. I went up to the PD to talk it over with the chief but he wasn't in so I got the LT. He agreed with me on the citation, but said without hearing the citing officers side he couldn't really advise on what to do, but he was really concerned with the officers ( captain mind you ) manner in which he spoke to Jenn. So tomorrow we are meeting with the citing officer, myself, the LT, the chief, and Jenn to talk this over. More than likely I will have to fight this for Jenn in traffic court cause he said they didn't dismiss tickets. I just don't see how jenn can be considered driving careless if she 1. avoided a collision, 2. the reason she breaked so suddenly was due to the vehicle in front of her who stopped suddenly, tried to make an improper left turn, and then merged back into oncoming traffic. I think he is the one who should have been citied. Court dates Jan 4th....but I'm hoping we can reach an agreement in the chiefs office tomorrow. Maybe the officer didnt see the other guy driving like a moron, and only say Jenn swerving, who knows.... Hope you can get that taken care of. I would suggest you either draw a sketch of the area to help explain what happened or maybe print out the area from google earth and then sketch it in. Just be sure to have your side of the incident documented and your "case" thought out so it sounds like you know she was in the right when you get in front of them. stevebeilgard Posted December 3, 2009 Report Share Posted December 3, 2009 go for it, kyle. just tell the judge what happened and back up jenn. now, the real point here is that the cop most likely will not even show up at court, so you win automatically. i suspect he'll drop the charges when he hears jenn's side of the story anyway. cops are reasonable folks and i'll bet he missed what the other car did. I truly hope the Captain did not see the other idiot's driving or he really needs to go back to the academy. That sounds like a bogus ticket and since you have LE background and you have the LT agreeing with you already hopefully you can explain your side, they will listen and you can get this taken care of buddy. Really was stupid and should not have been cited, just a my luck kind of deal. I took the time to write out everything as it happened and had it in front of me when I showed up at court and was prepared to explain. Pretty well was given the option by the judge after he looked at my record of going to driving school without an opportunity to explain. That is just nuts...it's rediculous how the attitudes and treatment by cops vary...He must have been in a bad mood. I think some cops use their "power" to their advantage to take advantage....
