Ferruginous aren't native to New York.

If you could get one perched it would be an easy ID. Pretty sure the 2 pictured are different birds. Look at the undersides of the wings, especially the tails. I could post the picture over at whatbird.com. There's a lot of really sharp bird people over at that site. I know you copyright all your pics Dave, so I won't do it unless you say it's OK.

Some people, I won't mention names, could care less about bird ID. They are content to see or hear a bird and say, "huh, bird." :yes:
