LifeNRA Posted February 20, 2005 Report Share Posted February 20, 2005 New York Animal Cruelty Bill Will Make Criminals of Sportsmen- (02/17) New York sportsmen should urge state lawmakers to defeat an assembly bill that will make hunting a punishable act of animal cruelty. Assembly Bill 1850, introduced by Assemblyman Alexander Grannis, D-New York, would revise the state’s definition of animal cruelty to include “killing or injuring...wild game and wild birds.” The revision would make legal hunting and trapping activities criminal offenses. The bill is being considered before the Assembly Agriculture Committee. “The bill creates a contradiction in the law as the state code allows regulated hunting,” said Tony Celebrezze, U.S. Sportsmen’s Alliance director of state services. “But the definition of animal cruelty in the bill makes hunting illegal. “If AB 1850 becomes law, anti-hunters will have a field day ensuring that sportsmen are prosecuted on animal cruelty charges,” said Celebrezze. Anti-hunting lawmakers nationwide are introducing vague or poorly worded animal cruelty legislation in an effort to outlaw hunting. Assembly Bill 1850 bares striking similarities to a Texas bill that would turn common hunting practices into criminal acts of animal cruelty. Sportsmen in Iowa and Connecticut have also had to defeat animal cruelty bills that threatened hunting with hounds. Take Action! New York sportsmen should ask your assemblymen to oppose AB 1850! JUSTIFICATION: This legislation will extend the coverage of the felony animal cruelty law to cover wildlife. Since the passage of the felony animal cruelty there have been a number of egregious cases in which wild animals have been captured and tortured. This bill would allow these cases to be prosecuted under the felony animal cruelty statute. It is important to note that in no way would this change affect the lawful hunting or trapping licensed by the Department of Environmental Conservation. The stringent standard of proof created by the "aggravating" factors contained in the felony law -- that require proof of intent to cause extreme physical pain or that the conduct was especially depraved or sadistic -- would remain unchanged, thereby ensuring that only the most heinous cases of the mistreatment of wild animals are treated as felony offenses. PRIOR LEGISLATIVE HISTORY: 2004: A.6507 - Agriculture 2003: A.6507 - Agriculture FISCAL IMPLICATIONS: None. Not trying to bash, I just know that from previous cut and pastes from NRA-ILA that they have a habit of not posting the whole story or making things seem worse than they are. With the advent of technoology and the internet I am amazed that any organization, political or otherwise, would post erroneous information when it is possible to dispute allegations within a matter of minutes. The amendment still has reason for concern for hunters, especially in the case of wounding an animal. This amendment will give the anti-hunters an edge in the courts. After-all, when a hunter decides to pull the trigger, that is intentional, is it not. And if he severely wounds an animal, but does not fatally wound it, could that not be interpreted in the courts as "an intentional act of extreme cruelty". Don't get me wrong. I'm all for prosecuting these people who mistreat and intentionally harm wildlife, pets and livestock, but do we really need the amendment to better enforce the laws already on the books.?? As an avid outdoorsman and hunter, you can't help but wonder, where these amendments will eventually take us, in the grand scheme of things.
