And a designated driver means someone or in this case, a horse would be designated to drive something...but that something is itself. Can something be designated to drive itself? I mean if the horse is going to walk to a certain destination without any outside influence, then the rider wouldnt have to guide him if he was sober, so the horse wouldnt need to be designated. Yes, I designate myself to drive everyday when I walk. So, by your last sentence, if the horse wasn't needed to be designated, since it doesnt have to be guided, then you could not get a DUI or DWI on a horse, because you don't have to "drive" it to get where it's going. Now public intoxication would be another story What would you consider "public". I understand streets, sidewalks, parking lots, etc. But what about dirt trails, fields, river beds, etc.? If its privately owned property then I dont consider it "public" but I know people get arrested for being out in there own yards. There is a gray area there.
