The post awhile back about the SD farmer shooting into the geese to scare them off. He was actually shooting at a decoy spread and he killed a guy??

well here is what haooened

Rancher faces endangerment charge in death

published: 01/29/05

A Martin rancher who accidentally killed a Custer man has been charged with a misdemeanor, negligent endangerment.

Jay Torgerson, 39, was hunting geese Dec. 3 near Martin when he was shot by a high-powered rifle.

The Bennett County state's attorney, Tim Vander Heide, said Brad Johnson, 51, was negligent in the shooting, but it wasn't grounds for a manslaughter charge.

Johnson said he thought the hunter's decoys were geese and he wanted to scare them off his father's land.

He could receive up to a year in jail and a $1,000 fine.

My father and grandfather are lawyer and they had a case where a boy accidentally shot his best friend and hunting partner. You have to look at it this way. This guy has to live his life facing the fact that he shot and killed someone. You know how bad he is going to feel from now until he dies? A day is not going to go by that he wont think of this incident. So yeah a year in jail and a 1000 dollar fine might seem light to you all. But the stress and guilt that man will face for the rest of his life is gonna be way worse than any punishment they could give him.

Thats well said for sure......but i would imagine that how one would feel is more dependant on what family your in...the Shooters or the Victims.

I don't know what the original story is, but I would have to agree that the sentence seems pretty light. If the victim was trespassing, that would diffinately have to be considered. I haven't waterfowl hunted for 11 years, but I see these chair blinds that look like geese, and I often wondered if an incident such as this one would happen Your sitting out in the field looking like a goose, sounds like trouble to me.

Well, I can see it happening by accident. I look at the blame in a fight or argument, but I guess I like to think a hunter wouldn't try to kill someone.

If a coyote/crow/varmit was on my dad's field, I'd certainly take a shot with my 270. If someone got hit by the shot and died (our neighbors live 1/2 mile from our field) it would certainly be an accidental shooting.

Would that deserve 10+ years in jail?
