The 48 & 5 run race with devices to add rear downforce, no penalty. The 29 qualifies with what NASCAR determines adds downforce and send him to the rear of the field. Harvick's front-row time disallowed at 'Dega Three rear-end violations send No. 29 Chevy to the rear Sunday By Marty Smith, NASCAR.COM September 30, 2005 09:18 PM EDT (01:18 GMT) TALLADEGA, Ala. -- Kevin Harvick qualified on the outside of the front row Friday at Talladega Superspeedway, but his time was disallowed after the No. 29 Chevrolet failed post-qualifying inspection. Following Harvick's qualifying run, the No. 29 Chevrolet was found to have a trio of illegalities in the rear end, sending him to rear of the field to start Sunday's UAW-Ford 500. According to NASCAR officials, the trunk area of the race car was not properly sealed, nor was it properly vented to the outside as prescribed in the Nextel Cup Series rule book. Also, the shock doors inside the trunk area were open, rather than secured as required. Added together, the three illegalities added rear downforce and less aerodynamic drag. NASCAR spokesman Jim Hunter said penalties likely would be levied early next week. Harvick had little to say other than "Ask (NASCAR). They don't know what they're doing from day to day." When asked to clarify the differences between the Nos. 48 and 5 Chevrolets initially failing post-race inspection at Dover with no penalties, and the No. 29's illegality at Talladega, Hunter said NASCAR looks at each transgression singularly. "I could understand that (sentiment), but I think every penalty is viewed as an independent penalty," Hunter said. "We've been consistent in saying that over a period of time. "Today's penalty has nothing to do with something that happens in another race at another time." He said the same goes for crew chief Todd Berrier, who is still serving season-long probation. According to Hunter, Berrier's prior transgressions had no bearing on NASCAR's decision. The penalty creates an all-Yates front row for Sunday's UAW-Ford 500, as pole-sitter Elliott Sadler will now share the front row with Dale Jarrett.

Re: 48 and 5 Fail Inspection...Again? Here is the article that is on NASCAR.com site Shocks run by Johnson, Busch bring rule change Controversial shocks were within rules at Dover; assembly is issue By Marty Smith, NASCAR.COM September 30, 2005 05:14 PM EDT (21:14 GMT) TALLADEGA, Ala. - The premier garage debate Friday at Talladega Superspeedway centered on suspect shocks run by Hendrick Motorsports teammates Jimmie Johnson and Kyle Busch en route to a 1-2 finish last weekend at Dover International Speedway. How can NASCAR allow Johnson and Busch to retain their respective finishes when their cars initially checked in too high during post-race inspection? Because according to most garage personalities asked, including NASCAR officials, neither team technically did anything wrong. According to Nextel Cup director John Darby, both cars' shocks were well within the rulebook guidelines and passed post-race inspection when given ample time for the shocks to settle into resting position. "There's nothing wrong with what they were doing," said Todd Berrier, crew chief for Kevin Harvick's Chevrolet. "We were all available to do the same thing. Fundamentally it's pretty easy to do, you've just got to be willing to work it all out. "And actually, I don't really think it's fair to take something away from somebody that's not blatantly doing something wrong." Rules change forthcoming Though NASCAR deemed the Nos. 48 and 5 fit to retain their finishing positions at Dover, the sanctioning body also felt strongly enough to confiscate the shocks. And after studying them for a week in their Concord, N.C., Research and Development Center have chosen to introduce a rules change. Darby said at some point this weekend the sanctioning body will issue a bulletin laying out new shock guidelines. Darby wouldn't specify what differences were forthcoming, but Berrier gave a clue. "Last year when they made a rule, people were running a lot of gas pressure in the shocks, and NASCAR was deeming that dangerous - 1,000 pounds, 600 pounds. So they backed it to 175 (pounds)," Darby said. "Now they're going to back it to 75. "I have a good relationship with John (Darby), and John told me that, after a really short amount of time, they were as legal as anybody else out there. If that's the case, then there shouldn't be a rules change." Yet one is coming. So the Nos. 48 and 5 teams were legal, but close enough to illegal to produce a rules change? "From a rules standpoint, these are the facts: the cars passed post-race inspection Sunday night," Darby said. "In regards to the shock absorbers themselves, after being tested and disassembled, all the parts and pieces are well within the confines of the rule book. "However, the shock build -- the assembly of the parts and what the shock is intended to do with that build -- is not within in the spirit and intent of the shock absorber rule. "Simply put, we prefer the shock absorbers are used for shock absorbers, which is a device that controls the frequency of a spring, not to be a spring assist or jack." Without being specific, Darby said one car checked in an eighth-of-an-inch low, while the other was a quarter-inch low. But it wasn't post-race inspection that led NASCAR to confiscate the shocks. "It was a little bit of post-race inspection, but watching the cars on the racetrack it was obvious that the car was traveling in a downward motion as most cars do," Darby said. "Every shock builder in the garage knows exactly how to do what those two teams built. The difference is, especially last Sunday, is there were 41 teams that understand what the spirit and intent of shock absorber rules are and two that may or may not have understood it, but chose to do it differently." So why no penalty? "Threaten me and you'll not get a penalty," Darby said. "Put a bullet in my head and you'll get a penalty. Without clear-cut evidence that proves the cars to be outside the rulebook, we don't have to (react.)" Chasers question decision Some Nextel Cup Series competitors were jealous of Johnson's technological advantage, while others questioned the validity of NASCAR's post-race inspection procedures. "That is the coolest part about racing -- looking at the rules and finding a way to bend them a little bit," Jamie McMurray said. "I think that is really cool and I am disappointed we didn't find that out. We do not work on projects like that. That is not just something we focus on, and in my opinion, we should." Ryan Newman and Greg Biffle, both in the Chase for the Nextel Cup alongside Johnson, were a bit more critical. "It all depends on what mood the inspectors are in," Newman said. "And I say that because there are times when we'll go through and they'll let us work on the car in the house to make it right before a race or qualifying or something like that. "So, there are times when they'll let you work on it, and there are times when they say, 'Go back in line and fix it.' I guess it's maybe just a gray area that they caught. I'll commend them on the fact that what they did was smart as far as what they did on the racetrack. "But when they didn't meet the rules coming back to the house after the race, then it isn't fair anymore. And even if he waits an extra half-hour or whatever it was, it's still not fair." To Newman's point, Darby said he is certain NASCAR's inspection process is viable, and that cars are often sent through the height sticks multiple times during post-race inspection. "It didn't pass the first time through, and I didn't see anything in the rule book that says, 'Cars will be given three opportunities to be made legal as they come through the house," Newman said. "Obviously, NASCAR is going to make some kind of decision as far as shocks or the process, but it's a little late for nine other teams right now." Biffle added, "If you guys remember, the same two race cars were docked points the third race of the season at Las Vegas. There's nothing different that happened at Dover that didn't happen there. Their cars were both too high in the tech. "They settled out, supposedly. I was not there so I don't know but our team engineer was there and has no reason to tell me any different. He said when both cars rolled up on the grid and they put the height sticks on they were too high and they took pictures of them too high. "Shortly thereafter the car settled down some, therefore they're legal. Right in the rule book, clearly, 'any device or anything that alters the height of the car beside the jack bolt,' which you put the thing down in and turn and raises and lowers the car, 'is illegal.' But let the general public or whoever make their own deduction from there." Ultimately, Berrier says the point is moot. "Everybody in this garage is smart enough to know if they're an eighth-of-an-inch high and we're all (complaining) about that, then we're a bunch of wimps and crybabies that are doing the wrong job," Berrier said. "Because there ain't an eighth-of-an-inch that's beat any of us."

This is the way my son passed time while we were trying to evacuate from Rita last week. It is kind of long, but pretty accurate. My Diary on Dad’s Laptop 9-22-05 I have been sitting here for 3 and one half hours. I have gotten ten miles in that time. Right now my dad has the truck in park and not one car is moving on our entire side of the highway. The reason everybody is sitting here is because we are all evacuating, because of the hurricane Rita. We are finally moving for once, and my favorite song in the world is on the radio. Now we are stopped once again. I am to the point that I just want to turn around and go home. My legs are very hot because of this laptop. We are on the way to my grandmother’s house. I hope this traffic will start to speed up. Since we have gotten on Highway 90 the highest speed we have gotten is twenty-four miles per hour. They only play music every thirty minutes, and it is getting very annoying. I had to save and shut down because the computer was getting to hot. While I was off I drove up on a guy who was walking almost a mile in 102 degree weather. Then I saw a guy who was passed out on the side of the road. He was struggling to breathe. Right now we are stopped again and people are even sitting in the back of their trucks. I thought the guy that was walking had turned and was walking to his house or something, but he had turned around again and has passed us. (That shows you how slow the traffic is moving, if earlier in the story was not good enough for you.) But we do not have it as bad as other people do. The radio is telling people to use the highway we are on as an alternate. We started to pick up speed for about a sixteenth of a mile, but I blew that when I said finally, we are picking up speed. I guess that will wrap it up for right now. I might get back on and type a little more if I think of anything See ya. (For now, maybe.) It is now dark so I guess you could say that it is night time. I don’t consider it night yet because it is only about 8. We are just now crossing the city limits to Liberty. I hate the fact that it has taken so long. My dad just told me that he doubts that we will make it to my grandmother’s house on this trip so I guess that I will have to wait until either Thanksgiving or Christmas break to see them. I really want to see them though. This really stinks. I just saw a truck carrying bunch of mid-60’s cars and trucks. Now we are in a contra flow. The police have the road we want to go on closed. I can’t figure out why it is closed though. Again we started to be able to drive fast and we got caught up in traffic. It looks like this traffic is ten miles long. The lane to our left is going very fast though our lane is going low. My dad finally got into the other lane. I thought that he was not ever going to. Now this lane is backed up. I am going to see if I can find out what is going on. It looks like the cops are flagging people like construction workers. But they are doing it with flashlights. We are sitting here trying to get on the highway. It looks like it will be hard to do that though. We are finally on the highway, but we are right back into traffic. (Unfortunately) we are behind a truck that has its hazard lights on for some unknown reason. I am trying to keep my eyes open for somewhere to eat or buy some snacks. So I am going to save and shut down. Bye Bye 9-23-05 It is 7:38. We have been on the road for 19 hours and 9 minutes. We have not stopped to get something to eat, use the restroom, or get something to drink. When the traffic stops my dad gets us a dr. pepper. But we only have one left. I have called it, but I don’t think I will get it. Now we are on highway 190, and it is moving great. We are going in the direction of Woodville. There was a Shell station, and there were probably three hundred cars lined up down the side of the road. We are actually driving 54 miles per hour. As far as I can see there are 4 cars on the highway, and they are all driving fast. (Thank the LORD) we are now in Tyler county. I am starving so I hope we can find somewhere to eat that is open. We just let 2 more cars pass us. I will now save and go play games, but I will be back later for sure. I am back. I probably just had one of the worst moments of my life. We stopped to let my animals get out and walk around. I took my dog down the ditch to walk and use the restroom. Then all of a sudden my dad called me over there. He told me that my cat had gotten away from him. So I went in the woods to try to find her. I saw her and went after her. She kept running away from me. I knew I couldn’t keep up with her but I thought that I could outsmart her. I thought wrong. I was trying to get her, but she kept running away. My dad asked me where I was and he saw me. He told me not to go any further. I started to cry because I thought we wouldn’t get her back. My dad gave me the dog and went after the cat. He told me to stop crying. I was scaring her. So I stopped crying. He got her and gave her to me. I thought that was the end of that, but I was wrong. When we were going back to she stuck her claws in me, and jumped out of my arms. He went after her, and got in front of her. He said he had gotten around her. He said he had to jump on her to get her. He put her in the cage and told me all the stuff that he had to do to get her. He rested for a little bit, then got in the truck and we left. We are now in bad traffic again, and it is very bad. I am so tired of this stupid traffic. It is so boring. I want to go to the Dairy Queen, but my dad won’t go there. He wants to try to find another place down the road. I am so hungry and I want to get something to eat very badly. We were going to go to the Sonic but there wasn’t enough space. These last two days have definitely been the worst two days of my life. I wish we would have stayed at home and tried to ride it out even though it was my idea to evacuate. There are more people on the road right now than last night, but we are going 20 miles per hour. The reason we are going so much faster is because of the contra flow lanes. Everybody is going in the same direction. Now traffic is real bad again. Now my lane is staring to speed up and slow down. It keeps on doing this and it is getting very very annoying. Now all four lanes and the shoulder are completely stopped. I am going to read my book for a little while, but I will be back typing again soon. Hey, I am back. I just finished the book I was reading. It was a great book. When I was off I went to get something to eat. My dad asked me what I wanted to eat, because I had to stay with he animals. So I went over and looked on a pole and told him that I wanted the chili cheese crunch with a root beer. He came back with my drink. Later he came back with my food. He undid the steps on the trailer, and I sat down and took a bite out of it. I realized that it had mustard on it. So I ate as much as I could and threw it away. Then we loaded up the animals and started to drive off. Now we are in bad traffic again. It is 99 degrees, and I am sweating. I have now turned the air vents on in the backseat. We are in a town called Crockett now and we are going to find a place to sleep. So I have to save , shutdown get my pants and shoes on so I will be ready to get out when we get there. So Bye Bye.

Re: Update on hurricane Rita I am getting ready to leave work, won't be back here until at least Monday, but will probably check in a couple of times from the house tomorrow. Right now I am planning on staying around, I think it will be making land fall far enough to the south of Houston that we won't have it to bad, but if anything changes, we will be joining all the other thousands of evacuees. Hearing it is taking over 5 hours to get from Galveston to Houston, about 45 miles. See ya in a couple of days

Re: Hurricane Rita I think we are seeing a lot of knee jerk reaction to the New Orleans debacle and things here in the Houston area are getting blown out of proportion. My son's school, along with numerous other schools were cancelled today, still approximately 72 hours before land fall, and they still do not have any ideal where it is going. Somewhere between northern Mexico and New Orleans. With the latest projection being around Palacios, which is approximately 100 miles SW of the Houston/Galveston area. I may ended up regretting this, but I, living on the east side of Houston, am just anticipating getting a little wind and a lot of rain. Now with that said, I am still monitoring the reports and am ready to get on I-10 and head east if Rita would happen to change it's direction and come in closer to the Houston area. Hope I didn't jinx myself by posting this, but I just get the feeling that due to the N.O. deal, everybody is over reacting.
